The Supreme People’s Court Issued Ruling Favorable to Domestic Mechanical Equipment Company Represented by Beijing East IP Ltd.

In December, 2013, the Supreme People’s Court issued a ruling favorable to a domestic mechanical equipment company (the “Company” hereinafter) represented by Beijing East IP Ltd., rejecting a re-trial application filed by a competitor of the Company.

In 2009, the competitor filed a patent infringement lawsuit against the Company seeking for a permanent injunction and claiming a damage of more than RMB 10,000,000. Beijing East IP Ltd. successfully represented the Company in both first and second instances by obtaining favorable judgments where all the claims of the competitor were rejected. As a continued action, the competitor filed a re-trail application before the Supreme People’s Court earlier this year. Our team of attorneys again successfully defended the Company, and the Supreme Court confirms in the ruling that no infringement is established.
